CAPULIN — DeShon Martinez, 20, charged in connection with a vehicle-pedestrian fatality in Capulin Sept. 23, appeared before Conejos County Judge Kim Cortez Monday to seek a bond reduction.
Charged with vehicular homicide, Capulin resident Martinez was booked in lieu of a $75,000 cash bond and defense attorneys asked for a reduction or even a personal recognizance bond, since he could live with his parents and his father would co-sign his bond.
Cortez noted that Martinez didn’t remain at the scene, but fled after striking and killing La Jara resident Juanita Martinez, 45, just north of Capulin on Colorado Highway 15.
According to the Colorado State Patrol, a white Subaru Forrester driven by DeShon Martinez was heading north on the highway and two pedestrians were walking northbound in the southbound lane.
The Subaru crossed into the southbound lane where it struck and killed the first pedestrian, Juanita Martinez, who was pronounced deceased due to the injuries sustained in the crash. The second pedestrian, identified as Seantrei Waldroupe, 18, of Manassa, was walking just off the left side of the road and was struck by the vehicle or debris from the first collision. He left the scene with minor injuries.
DeShon’s Subaru continued northbound, off the left side of the road, where it struck a fence and a utility pole before rolling and coming to rest on its right side. According to the State Patrol, the driver received serious injuries in the crash.
Alcohol and speed are believed to be contributing factors and seat belts were not in use.  Juanita Martinez”s family was in the courtroom and had indicated to Deputy District Attorney Ashley Fetyko that they were opposed to allowing the driver to be freed.
