Incidents in Capulin area keep sheriff busy-Burglary

Horner cornered after burglary report

CAPULIN — A man was arrested July 10 following a break-in and discharge of a weapon in Capulin.
According to the Conejos County Sheriff, a call came in regarding a burglary in progress at 8000 County Road Z. Upon arrival, she found Joseph Horner, 38, of La Jara being detained by Karl Jones.  
Jones had arrived at the residence to drop off some personal property because he and his wife were preparing to move into the home that belongs to Jones’ cousin Wendy Jones.
When he arrived, Horner was walking out of a nearby camper claiming the owner gave him permission to be on the property. Horner then allegedly  started “come at” Jones twice. Both times Jones fired a weapon into the ground behind Horner.
Jones reportedly said the back door to the house and the camper were broken.
The total cost to repair the doors was estimated at $300.
After backup officers arrived on the scene, Horner was transported to the Conejos County Hospital where he resisted assistance and  allegedly head-butted a nurse.
Initial sheriff's reports alleged Horner was charged with felony first-degree burglary, and misdemeanors theft and criminal mischief.
He is being held in the Conejos County Jail. His first appearance in court is Monday, July 15 for advisement of his rights, and then on Monday, July 22 for an arraignment.
The sheriff's report for the week said   Horner,was booked July 10 for first-degree burglary and criminal mischief.
