Neighbors spar over eight foot wall being built in Capulin

CAPULIN — While the fate of a very large wall is being debated in Congress, an eight foot fence is drawing fire in Conejos County.
The Conejos Board of County Commissioners (BOCC) have been dealing with the concerns of Lewis Legar regarding a tall fence being built by his back door neighbor.
Legar told the BOCC Sept. 7 that the fence builder knocks at his door late at night. Legar has erected gates and a privacy screen on his own property and is irritated by the sounds late at night.
He told the commissioners that the neighbor claims his (Legar’s) light shines into his daughter’s bedroom window.
Legar said he didn’t know the neighbor had anyone living with him and, in fact, didn’t know the mobile home behind him was occupied.
He told Sheriff Howard Galvez Jr. that the law had offered no satisfaction and a deputy had called him in August to state, “What I’m doing can’t be done.”
Legar said he would fire off a shot or two, but he isn’t permitted to own or have access to weapons and is legally blind, so he’s seeking law enforcement and legal action.
He also has powerful hearing aids that he takes off at night, “so the noise has to be really loud for me to hear it.”
Legar was advised that the neighbor could do what he wants on his own property, even build an eight foot wall.
“I just want to be left alone,” Legar said, explaining that the neighbor could build in the daytime.
Advised that sheriff’s deputies have seen nothing illegal, Legar said he wants them to slow down while driving through town.
An application for a permanent restraining order agains the neighbor will be heard in court at 10:30 a.m. Oct. 3.
